An Introduction
Generic Drugs are the drugs which are sold in the market without any brand name. The manufacturer’s of generic drugs do not reserve any patent about the drug name and sell them with their original general/medical names. To understand the concept, let’s take the example of Paracetamol- a drug widely used as pain killer.
The medical name of the drug is Acetaminophen but was introduced in the US market by Sterling-Winthrop Co. under the brand name, ‘Paracetamol’. Sterling- Winthrop Co. registered the brand name and got the patent from FDA when it was first introduced in 1953. Many other pharmaceutical companies are marketing Acetaminophen under different brand names. The US patent of Paracetamol has long been expired and now the drug is available with its generic name i.e. Acetaminophen.
The generic names of drugs mainly refer to the significant ingredient of the medication. Apart form Acetaminophen, the patents of hundreds of other medications have been expired and are now marketed with their generic names as well. Once the patent expires, the drug can be manufactured and marketed by any pharmaceutical company.

When a company produces any drug and acquires the patent for the drug it reserves sole rights to sell that drug. However, when the patent expires any other pharmaceutical company can manufacture the drug. Generic drugs can be produced when:
1. The patent of the drug expires.
2. When the patent is declared invalid.
3. When there is no patent registered for that particular drug.
4. In territories where there’s no laws to issue a patent or to protect the issued patents.
